Program: Reliance Retail Limited (“Reliance") offers this program (“Tira Treats” or “Program”), starting 21th Feb’24 (“Commencement Date”). Any person, who (i) is an individual resident of India as defined under the Income Tax Act, 1961); (ii) is of eighteen (18) years of age or above and has the capacity to enter into a legal contract; and (iii) meets such eligibility conditions as may be stipulated by Reliance from time to time; can participate in the Program (“Tira Treats Member”) at the time of shopping for the products sold or offered by Reliance on the website www.tirabeauty.com and its corresponding mobile application (collectively, “Tira Platform”). As part of Tira Treats, Tira Treats Members can earn points (“Tira Points”) and use such points to redeem products from the rewards catalogue accessible on the Tira Platform as detailed henceforth in these terms and conditions (“Terms”)

Enrolment: Participation in Tira Treats is subject to compliance with these Terms together with the Tira Platform https://www.tirabeauty.com/page/terms-and-conditions. Reliance may at its sole discretion, reject enrolment in Tira Treats for reasons it deems appropriate.

Expiry and Amendments: Reliance further clarifies that Tira Treats replaces the existing Tira Loyalty Program on and from the Commencement Date. Tira Loyalty Program and all benefits accrued under the Tira Loyalty Program will stand suspended from the Commencement Date, except to the extent set out in these Terms.
Reliance reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify Tira Treats and/or any part thereof including the eligibility criteria and other pertinent terms and conditions at its sole discretion at any time during its validity, as may be required, including, in view of business exigencies and/or changes by a regulatory authority and/or statutory changes and/or any reasons beyond their control and the same shall be binding on the Tira Treats Members. -
Acceptance: A person’s completion of a transaction on the Tira Platform on or after the Commencement Date shall be deemed to be explicit acceptance of these Terms. Tira Treats Member hereby acknowledges that he/she has understood and unconditionally accepts these Terms. Any Tira Treats Member providing incorrect information or concealing/withholding any information from Reliance with intent to participate in Tira Treats will automatically be disqualified from participating in it. Reliance’s determination of such disqualification, at any point of time, shall be final and binding.

Privacy: All information collected in the course of applying for and participating in Tira Treats shall be in accordance with Reliance’s privacy policy available at https://www.tirabeauty.com/page/privacy-policy (“Privacy Policy”). The Privacy Policy is an integral part of the Terms and acceptance of the latter shall be construed as explicit consent and acceptance of the Privacy Policy.

Electronic Record: These Terms are an electronic record in terms of the Information Technology Act, 2000 (as amended / re-enacted) and rules thereunder and is published in accordance with the provisions of Rule 3 (1) of Information Technology (Intermediaries Guidelines and Digital Media Ethics code) Rules, 2021, which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of application. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Tira Treats Overview: Tira Treats is a tier based loyalty program which is made available to Tira Treats Members in accordance with these Terms. Each Tira Member will be classified into one of the tiers of Tira Treats as given in Table A below basis the purchases made by the Tira Treats Members on the Tira Platform. Each Tira Treats Member will be eligible to avail the benefits available for the relevant tier as set out in Table B below. For the avoidance of doubt, Tira Treats is open to (i) all new users on the Tira Platform who are eligible to become a Tira Treats Member by meeting the ‘Eligibility Criteria’ as set out in Table A below; and (ii) all existing Tira Loyalty Members who will be transitioned to Tira Treats in accordance with these Terms (“Transitioned Tira Treats Members”) (please refer to clause 11 for additional details).

*At the expiry of the ‘Validity’ period as provided in Table A (above), Reliance will determine the total Platform Spend (as defined below) of the Tira Treats Member in the preceding 12 months period. Depending on the total Platform Spend achieved by the Tira Treats Member in the preceding twelve months, the relevant Tira Treats Member will be re-classified into the appropriate Tira Treats tier basis the ‘Eligibility Criteria’ given in Table A (above).
Illustration: If a Tira Treats Member is presently in the Tira Muse tier, but at the end of the validity period, Reliance determines that the total Platform Spend achieved by the relevant Tira Treats Member is INR 4000 in the preceding 12 months, then the relevant Tira Treats Member will be moved to the Tira Fan tier.

* Tira Points will be calculated as whole numbers and will not be earned in decimal points.
** Platform Spend means the final cart value on the Tira Platform (which includes GST), after deduction of all applicable discounts.
*** Tira Treats Members who are in the Tira Muse and Tira All Star tiers will be eligible to (i) earn additional Tira Points; or (ii) avail special discounts on purchases made on the Tira Platform on special sale dates as communicated by Reliance from time to time (“Big Sale Days”). The details of such additional discounts and offers made available on Big Sale Days will be communicated to Tira Treats Members on the Tira Platform from time to time. Such discount and offers may be subject to additional terms and conditions.

Earning Tira Points: Tira Points (referred to in Table B above) can be earned in one of the following ways (“Accrual Process”):
(i) Tira Treats Member, on and after the Commencement Date, purchases certain products on the Tira Platform and such Products are not returned by the Tira Treats Member during the return period and/or return request raised within the return period is not accepted in accordance with the Return and Cancellation Policy (“Transaction Mode”); or
(ii) Tira Treats Member undertakes and completes certain tasks/activities advertised on the Tira Platform and accrues the corresponding Tira Points for completions of the relevant task/activity as reflected on the Tira Platform (“Non Transaction Mode”).
Tira Points earned either under the Transaction Mode or Non Transaction Mode cannot be encashed and do not carry any real money value. The Tira Points accrued pursuant to these Terms will have validity period as set out in the table below:

Tira Treats Member can check the current balance of Tira Points (under the Transaction Mode and the Non Transaction Mode) by visiting the Tira Platform and through authenticated login credentials. Reliance’s computation of Tira Points shall be final and binding on the Tira Treats Member. The Tira Treats Members will not be able to redeem their Tira Points post the expiry of the validity period as set out in Table C above.

Redeeming Tira Points:Tira Points earned under Tira Treats can be only be redeemed by purchasing products (“Redemption Product”) listed in the product catalogue available on the Tira Platform (“Rewards Catalogue”). Please note Reliance will display against each Redemption Product in the Rewards Catalogue, the number of Tira Points required to redeem the relevant Redemption Product.
The Tira Treats Member must have sufficient Tira Points balance in their account to be eligible to redeem the relevant product from the Rewards Catalogue. Any redemption of the Tira Points shall strictly be in accordance with these Terms and cannot be clubbed with any other offer or scheme.
Please note, Tira Points cannot be redeemed to purchase Redemption Products as a standalone transaction on the Tira Platform. Tira Treats Member must purchase one or more products from the Tira Platform with a cart value exceeding ₹299 (after all applicable discounts) to be eligible to procure Redemption Products from the Rewards Catalogue. To clarify further, Tira Treats Member must have other products in its cart with a cart value exceeding ₹299 (after all applicable discounts) to be able to redeem and add a Redemption Product to its cart for successful checkout. -
Referral Points: Tira Treats Member will also be eligible to earn Tira Points for referring new users on the Tira Platform (each a “Referral Customer”). If (i) the Referral Customer successfully signs up to the Tira Platform using the referral code provided by the relevant Tira Treats member; and (ii) makes a transaction on the Tira Platform of a minimum amount of ₹1299 within 14 days of signing up pursuant to this clause, then at the expiry of the return period for the relevant products purchased, both the relevant Tira Treats Member and the Referral Customer will be eligible for 200 Tira Points which will be credited to their respective accounts. Any Tira Points earned under this mechanism will be treated as Non-Transactional Points and will have the corresponding validity. You can earn referral points from a maximum of 5 successful referrals

Carried Forward Points: Tira Treats Member who were part of the Tira Loyalty Program will be eligible to carry forward their unexpired points (accrued by them under the erstwhile Tira Loyalty Program) to Tira Treats (“Carry Forward Tira Points”). Carry Forward Tira Points will be valid for a period of 90 days from the Commencement Date. Carry Forward Tira Points will be identical to Tira Points in all other respects and can be redeemed in accordance with clause 9.

Giveaway Points: Reliance may, at its sole discretion, provide you with Tira Points from our end (“Giveaway Tira Points”). Giveaway Tira Points will have a validity period of 90 days. Giveaway Tira Points will be identical to Tira Points in all other respects and can be redeemed in accordance with clause 9.

Additional Conditions: Tira Treats is available for the personal use and benefit of an individual only and not for commercial use or for use by enterprises, including companies, partnerships and sole proprietorships. Tira Points are credited to a Tira Treats Member which is meant solely for his/her personal consumption. A Tira Treats Member is identified by the mobile number he/she registers and therefore, the Tira Treats Member shall ensure that the registered mobile number on the Tira Platform belongs to such Tira Treats Member and is accurate and up-to-date.
Reliance will not be responsible for any loss of Tira Points due to loss, misuse, surrender or transfer of mobile number by Tira Treats Member.
In the event of any change in the registered mobile number, it will be the sole responsibility of the Tira Treats Member to promptly inform Reliance and strictly adhere to the process of updation or change of his/her registered mobile number, with necessary documents of proof, as may be stipulated by Reliance from time to time. Under no circumstances will Reliance be responsible in any manner for any delay on the part of Tira Treats Member to inform any change of registered mobile number or failure to adduce necessary documents of proof or adherence to process for effecting such change in the records of Reliance.

No Transfer of membership: Reliance does not allow a Tira Treats Member to transfer its membership to another individual and as such cannot be pooled with, combined or transferred to any other mobile number.

Cancellation and Returns Policy: Please note any cancellation/ return request for Redemption Products procured under the Tira Treats Program will be governed solely by the terms and conditions of the Cancellation and Refund Policy applicable to the Tira Platform.
For the avoidance of doubt, and notwithstanding anything to the contrary in the Return and Cancellation Policy, you will not be eligible for any cash refund if Reliance accepts your cancellation/return request for Redemption Products. Instead, on successful acceptance of cancelled/returned Redemption Products, Reliance will credit back to you the corresponding number of Tira Points that you had spent in redeeming the relevant Redemption Products.
Please note if you have used Tira Points to avail discounts on the Tira Platform (pursuant to these Terms) such Tira Points will not be eligible for refunds.

Statutory Compliances: Reliance, may from time to time, in compliance with extant regulations and applicable law, impose additional terms and conditions that may be necessary for ensuring compliance of the Program with extant law. Such terms and conditions shall be binding upon the Tira Treats Member.

Indemnity: The Tira Treats Member shall indemnify and keep indemnified Reliance and their officers, directors, employees, customers, and affiliates harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which Reliance may incur, pay or become responsible as sponsor/organizer/facilitator as a result of (i) breach or alleged breach of the representations or obligations by the Tira Treats Member under the Terms hereunder; (ii) any failure by the Tira Treats Member to comply with applicable law; and (iii) any third party claim in respect of misuse of any information of a third party by the Tira Treats Member.

Force Majeure: Reliance’s obligation under the Tira Treats is subject to force majeure circumstances including without limitation, floods, epidemic, lockdown, natural disasters, war, act of terror, political unrests, technical snags, act of God, change of laws or any circumstance beyond the reasonable control of Reliance (“Force Majeure Event”). Reliance shall not be liable for any delay or adverse effect caused to Tira Treats as a result of a Force Majeure Event. If a Force Majeure Event occurs, Reliance shall not be responsible for any damage or loss which Tira Treats Member may suffer by reason of such a failure or delay of performance, and such failure or delay shall not be a breach on part of Reliance.

Waiver and Assignment: Failure by Reliance to enforce any of their rights at any stage does not constitute a waiver of those rights. Further, Reliance may assign any of its rights within Tira Treats to any party without prior intimation to Tira Treats Member.

Marketing and Promotion: By participating in the Tira Treats, Tira Treats Member grants to Reliance a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, assignable license to display, publish, announce or refer the details or name of the Tira Treats Member (“Member Material”) in any form, electronic or print manner, venue, media or technology now known or later developed for any and all purposes, including, without limitation, for purposes of trade, advertising, and promotion as Reliance and its licensees or assignees determine, without any further compensation, notification, or permission.

Disputes: All disputes in connection with Tira Treats (“Dispute”) within 15 (fifteen) days from the commencement of such Dispute shall be solved amicably. In case of such failure, the Dispute shall upon the expiry of the aforesaid period, be referred to e-arbitration to be conducted by a sole arbitrator, who shall be jointly appointed by Reliance and Tira Treats Member involved in the Dispute from the panel of available e-arbitrators. All arbitration proceedings may be conducted through mode available on the internet or any other information and communication technology (including but not limited to video call system, telephone or mobile, fax, e-mail facilities) which can be beneficially used to solve disputes. All Arbitration proceedings shall be held in accordance to the provisions of Arbitration and Conciliation Act, 1996. The language of arbitration shall be English. The arbitral award shall be final and binding on the Parties. The award may include costs, including reasonable advocates’ fees and disbursements.
Subject to the above clause, all disputes in connection with the Tira Treats Program are subject to the laws of India and subject to the exclusive jurisdiction of courts at Mumbai.
